Any liability is limited to the amount covered under the firm’s professional indemnity policy, plus the amount of the excess which under the policy conditions is not borne by the insurer.
Dispute settlement rules
Schoemaker Advocaten renders services under the Complaints and Dispute Settlement Scheme for the Legal Profession (Klachten- en Geschillenregeling Advocatuur). The complaints handling scheme concerns the internal complaints procedure.
Under the dispute settlement scheme, all disputes which may arise from the manner in which our services have come about and/or the manner in which they are rendered, including any fee disputes, are settled in accordance with the Legal Profession Disputes Committee Rules (Reglement Geschillencommissie Advocatuur). If the dispute concerns an instruction from a private client, the Rules provide for a binding opinion, unless the client in question applies to the ordinary court within one month after settlement of the complaint by the lawyer. If a debt is recovered from a private client, a binding opinion may only be provided if this client pays the amount outstanding into an account held by the Disputes Committee. If he fails to do so, the debt collection is submitted to arbitration.
